According to Section 409(h)(1)(C) of the Federal Food, Drug, and Cosmetic Act, food contact substance notifications (FCNs) are effective only for the listed manufacturer and its customers. Other manufacturers must submit their own FCN for the same food contact substance and intended use.
Food Contact Substance: Polyphosphoric acids, polymers with hydroxyl-terminated epoxidized polybutadiene (CAS Reg. No. 1429907-37-8).

Intended Use: As an adhesion promoter in resinous and polymeric coatings complying with 21 CFR 175.300 or effective notifications, except for use in contact with infant formula and breast milk (see Limitations/Specifications).
Limitations/Specifications: At a level not to exceed 6% (w/w) based on the solid content of the coating. Coatings containing the FCS may be applied onto the metal substrate for single-use applications in contact with beverages, Food Types I, II, IVB, and VI except those containing greater than 15 percent alcohol, under Conditions of Use A through H, as described in Table 2. The FCS is not for use in contact with infant formula and breast milk. Such use was not included as part of the intended use of the substance in the FCN.
